Welcome to iWishYou. These Terms and Conditions ("Terms") govern your use of our website and the services we offer for creating and sharing personalised birthday web pages. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.

1. Your account

To use most features you need an account. You agree to provide accurate information and to keep it up to date. You are responsible for the activity that happens under your account, so please keep access to your email secure, since we use it to sign you in. You must be old enough to form a binding contract in your country to use the service.

2. Acceptable use

We built iWishYou to spread warmth and celebration. To keep it that way, you agree that you will not:

• Upload or publish content that is unlawful, hateful, harassing, threatening, or defamatory.
• Upload sexually explicit content, or content that exploits or endangers any person.
• Impersonate another person or misrepresent your connection to anyone.
• Publish content that infringes the copyright, trademark, privacy, or other rights of others.
• Use the service to send spam, to distribute malware, or to attempt to gain unauthorised access to our systems.
• Upload the personal information of another person without a lawful basis to do so.
• Interfere with, disrupt, or place an unreasonable load on the service.

You are responsible for making sure you have permission to use any photo, video, name, or other detail you include about another person.

3. Your content

You keep ownership of the content you create and upload, including messages, photos, and videos. By using the service, you grant us a limited licence to store, process, display, and deliver that content for the sole purpose of operating the service for you. For example, we need this permission to publish your page and to email a scheduled greeting to the recipient you choose.

We do not claim ownership of your content, and we will not use it for any purpose other than running the service, unless you give us clear permission to do so.

4. Web addresses for pages

Each wish page is published at a web address that you select. Web addresses are offered on a first come basis and are subject to availability. Some words are reserved or blocked, and we may refuse or reclaim any address that is misleading, that infringes the rights of others, that impersonates our brand, or that is otherwise inappropriate. An address is provided for use with the service and does not transfer any ownership right to you.

Payments

Creating a wish page may require a payment based on the plan you choose. Payments are processed by our payment gateway, Cashfree, and by making a payment you also agree to the gateway's terms. Prices are shown before you pay and are inclusive unless stated otherwise. A page is only created once the payment is confirmed. If a payment fails or is not completed, no page is created. Any refund, where due, is handled through the original payment method.

5. Suspension and termination

We may suspend or close an account, or remove any page, if we reasonably believe these Terms have been broken, if it is necessary to protect other users or the service, or if the law requires it. Where it is practical and appropriate, we will let you know. You may stop using the service and delete your account or your pages at any time. When a page is deleted, its uploaded media is removed as well.

Page lifetime and expiry

A wish page may be offered on a plan that gives it a fixed lifetime, measured as a number of days after which the page expires. When a page expires, its link and details stop working. Once a wish page is expired or deleted, the photo or video you uploaded for that page is permanently deleted from our storage and cannot be recovered. Please keep your own copy of anything you wish to save. We are not responsible for content that has been removed after a page expires or is deleted.

6. Disclaimers

We work hard to keep iWishYou delightful and dependable, but the service is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be uninterrupted, error free, or that a scheduled delivery will arrive at the exact chosen moment in every circumstance, since delivery can depend on systems outside our control. To the fullest extent permitted by law, we disclaim warranties that are not expressly stated in these Terms.

7. Limitation of liability

To the fullest extent permitted by law, iWishYou will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of data, goodwill, or profits, arising from your use of the service. Nothing in these Terms limits any liability that cannot be limited under applicable law.

8. Changes to the service and these Terms

We may improve, change, or discontinue parts of the service over time. We may also update these Terms as the service evolves or as the law changes. When we make a meaningful change to these Terms, we will update the date at the top of this page. If you continue to use the service after a change takes effect, you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of India, without regard to conflict of law principles. The courts located in India will have exclusive jurisdiction over any dispute arising from these Terms or your use of the service, unless applicable law grants you the right to bring proceedings elsewhere.
